Judith Nabakooba, on Thursday while addressing the press at the Uganda Media Centre in Kampala.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Minister stated that the halt follows a surge of complaints from proprietors, financial institutions, and estate administrators over certificates allegedly obtained through fraudulent and irregular means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judith Nabakooba affirmed that every parcel of land must hold only one legitimate title, insisting that no citizen should lose their property due to manipulation of the replacement process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;One parcel of land must have one legitimate title. The Land Register must be trusted. No Ugandan should lose his or her land because another person was able to manipulate the process for obtaining a Special Certificate of Title,&#8221; the Minister declared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Sections 70 and 71 of Uganda&#8217;s Registration of Titles Act, Special Certificates of Title are issued as lawful replacements for lost, destroyed, or illegible original titles, following a statutory declaration by the registered proprietor and a mandatory 30-day Gazette notice inviting public objections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minister Nabakooba warned that the legally sound replacement procedure, designed to protect genuine landowners, has been dangerously exploited by unscrupulous individuals orchestrating sophisticated land fraud schemes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The complaints include double titling, overlapping interests, fraudulent statutory declarations, manipulation of succession processes, and irregular transfers based on Special Certificates while the original titles remain in existence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minister Nabakooba emphasized that the immediate three-month suspension is not meant to abolish the statutory mechanism for replacing genuinely lost titles, but rather to allow a comprehensive review of procedures and institutional safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She underscored that certificates of title represent registered proprietary interests relied upon by citizens, courts, financial institutions, investors, and purchasers when making decisions of substantial economic value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;We recognize that a certificate of title represents a registered proprietary interest and is relied upon by citizens, courts, financial institutions, investors, purchasers, and other institutions when making decisions involving substantial economic value,&#8221; Nabakooba explained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the suspension, the Ministry will collaborate with investigative agencies, the Uganda Law Society, the Uganda Bankers Association, the Private Sector Foundation, the Survey Registration Board, and other bodies to develop a stronger, more transparent, and accountable framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Minister has since clarified that the evidence-based review will correct past mistakes according to the law, strengthen inadequate procedures administratively, and recommend legislative amendments to the Registration of Titles Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minister Nabakooba warned that public officers found responsible for misconduct will face disciplinary action, while third parties who collude or submit false information will be investigated and prosecuted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She has directed the Permanent Secretary to constitute a technical team with clear terms of reference outlining the three-month timeline, scope of work, and deliverables, and has instructed the Office of Titles to notify courts about the suspension.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The review will be evidence-based and will correct past mistakes, strengthen weak procedures, and recommend amendments to the law. Officers found guilty of misconduct will face discipline, while third parties who collude or lie will be investigated and prosecuted.
